Voiko huostaanottoon suostua? -seminaari

Suomalaisessa lastensuojelussa tehdään päätöksiä lapsen ottamisesta huostaan kahdella eri tavalla riippuen huoltajien ja 12 vuotta täyttäneiden lasten kannasta. Valtaosa huostaanotoista perustuu suostumukseen. Tämä käytäntö on herättänyt tutkijoiden kiinnostuksen. Monitieteisen, Suomen Akatemian rahoittaman tutkimuksen ”Suostumus ja tahdonvastaisuus lastensuojelun päätöksenteossa: sosio-legaalinen tarkastelu” tuloksia esitellään ja niistä keskustellaan päätösseminaarissa 12.2.2021. Tilaisuus on avoin kaikille kiinnostuneille.

Is consent possible in care order decisions? Cross-country reflections and Finnish research findings on child protection decision-making

The purpose of the seminar is to gather together child welfare practitioners, researchers, decision-makers and everyone interested in the complex topic of care order decision-making and to discuss the Finnish anomaly of dividing care order decision-making into two types: consent and objection based care orders. The thresholds, preparatory processes, legal criteria and implications are similar for both types; it is only the decision-making body that differs as a result of the view of the parents (custodians) and the child (if 12 years or older).
The seminar is organized as part of the research project Consent and objection in care order decision-making: a socio-legal analysis, funded by the Academy of Finland. This seminar presents some of the preliminary findings of the analysis of legal documents, case files, social workers’ interviews, administrative hearings and stakeholders’ group discussions, and puts them into a cross-country reflection. The cross-country views will be presented by an interdisciplinary group of experienced researchers from England, Ireland, Norway and Sweden, all countries having ‘voluntary removals’ but no differentiation of care orders based on the views of the parties in question.
