Corrective moves in child protection decisions
Consent and objection play an important part in Finnish child protection decision-making. Care order decisions, for example, are made differently depending on whether the parents and/or a child (12 years or older) agree or disagree with the care order proposal. Despite their important role, consent and objection have been little explored. In particular, very little is known about parents’ and children’s actions when they want to revisit and alter their given consent to the care order. The term ‘corrective moves’ refers in this study to parents’ and children’s attempts to change the child protection decisions, which they might have given their consent to, by using the formal ways available: making appeals.
This socio-legal project examines a selection of appeals to the administrative courts and related decisions. The appeals are made about care orders, restrictions of contact and emergency placements.

Huostaanottopäätös ja korjaavat liikkeet
Lapsen ottaminen huostaan voi tapahtua joko asianosaisten suostumuksen tai vastustuksen pohjalta. Suostumus ja vastustus ovat jännitteisiä, joskin vähän problematisoituja asioita lastensuojelussa. Huostaanoton lakkauttamista voidaan hakea hallinto-oikeudelta. Näitä ja muita huostaanottoon liittyviä hakemuksia ja niiden päätöksiä tutkitaan ajatuksella, että niissä pyritään korjaamaan huostaanottopäätöksenteon virheitä. Näistä korjaavista liikkeistä ei tiedetä juuri mitään ja siksi tutkimusryhmän sosio-legaalinen luenta tulee avaamaan uusia näköaloja. Kenen oikeudet ovat vahvoja korjaavissa liikkeissä?
